1. Service and participation

ColorWombat creates AI coloring pictures and printable PDFs from descriptions. You can discover and use approved pictures in the shared catalog. The service is free, with no paid features.

Only adults aged 18 or over may create their own AI pictures. Adults and parents may create fictional coloring pictures for children. The children do not themselves generate pictures through the service. Do not include personal information about children or other real people in these ideas either.

Generation is unavailable to anyone under 18, including with parental permission. Access for minors is not part of this service. To create pictures, you must state that you are at least 18; the other access requirements also apply. This age statement is a self-declaration, not verified identity. Accepting these Terms does not replace the age statement.

You can browse the catalog and print its approved pictures within the permitted scope regardless of this age selection. The same approval requirements apply to suitable pictures entering the shared catalog, regardless of the requesting person’s age.

2. Your description

Describe fictional, family-friendly scenes without personal information or recognizable real people. Do not upload photos. Only use content you have the necessary rights to process. Unlawful, violence-glorifying, discriminatory or sexually exploitative content is prohibited.

AI generation and content checks can make mistakes. A particular result, exclusivity or freedom from third-party rights is not guaranteed. Statutory claims remain unaffected.

3. Publication in the catalog

Pictures you generate from descriptions are intended for the shared catalog. They may be published after successful content, quality, privacy and rights checks. They remain private until fully approved. There is no entitlement to publication. The description you entered to create the image is not published.

These Terms apply to new pictures. For pictures created earlier, the Terms accepted at that time remain applicable. Existing private pictures and photos are not thereby approved for publication. Older material without recorded acceptance receives no new permission through this change.

4. Permission to ColorWombat and your own result

To the extent you hold rights you may license in your input and resulting picture, you give ColorWombat non-exclusive, worldwide permission to process, store, technically adapt and convert this content into previews and PDFs for the requested service. Necessary service providers may be involved to the extent required.

For an approved picture, this also covers catalog publication, reproduction, distribution and passing on the permissions in section 5. The original input is excluded from publication. You remain free to use your picture and permit others to use it.

If you personally request a picture to be generated through ColorWombat, ColorWombat grants you, to the extent it holds or may pass on the relevant rights, free, non-exclusive, worldwide permission for the duration of those rights to use that result commercially too, including selling it as a picture or in coloring books or other products. This permission also applies if your result later appears in the catalog. The limitations concerning protection, authorship and third-party rights, and the exclusions for the name, logo and design in section 5, also apply to this permission.

Your permission to ColorWombat is limited to this service and catalog use. It is not general permission for marketing, photos or training. No remuneration is agreed unless mandatory law requires otherwise. Permission for input lasts as long as processing and retention are necessary; for catalog pictures, until removal from the service. Permissions validly granted for downloaded pictures continue as provided by law. Non-waivable moral, remuneration, revocation and data protection rights remain unaffected.

5. Using catalog pictures

For expressly approved catalog pictures that you did not personally request to be generated through ColorWombat, to the extent ColorWombat holds or may pass on the relevant rights, you receive free, non-exclusive, worldwide permission for the duration of those rights to download, copy, print, color, adapt, redistribute and publicly display the original or adapted pictures solely for private purposes and educational use in teaching and childcare. Ordinary teaching and childcare use by schools, childcare facilities and teachers is also permitted when teachers are paid or the institution charges fees. Such pay or fees alone do not exclude the permitted use.

For this use of other people’s catalog pictures, commercial exploitation is excluded from the permission, including selling individual pictures or picture collections, or incorporating them into coloring books or other products offered for sale. This also applies to such picture or product sales in education. This restriction applies to the permission granted here for other people’s catalog pictures; the express permission for your personally requested result in section 4 and any rights you hold remain unaffected. Editing another person’s catalog picture does not by itself count as personally requesting generation through ColorWombat.

Credit to ColorWombat is welcome but voluntary. Third-party rights, including trademarks, personality rights and rights in other works, remain unaffected. Neither permission guarantees copyright protection, authorship, exclusivity or freedom from third-party rights. This text creates no new protection where none exists.

The ColorWombat name, logo, mascot, website design, text and software are excluded. A picture appearing in the catalog does not by itself establish express rights clearance.

6. Reset, removal and reports

In a normal browser, your age statement and acceptance apply only to the open page. Confirm both again after reloading or reopening it. Only in the installed web app may you optionally choose “Remember on my personal device”. The current record is saved only with both required confirmations; the normal website does not adopt it. Earlier browser records are not adopted as new acceptance. You can reset both statements in the Create form; in the web app this also revokes its record. Reset does not delete pictures or cancel ongoing jobs. See Privacy for storage errors and shared-device limitations.

You can delete private results from your result list. For published pictures, this action removes only your list entry and private template. The catalog picture remains available.

To report a picture, open it and choose “Report picture”. For privacy, catalog removal or a rights request requiring a reply, use the contact in Operator details. Include the picture address and reason without unnecessary sensitive information. Downloaded copies cannot be recalled. Valid statutory erasure and injunction rights remain unaffected.

7. Version and statutory rights

Each request is governed by the version accepted for that request. Material changes require fresh acceptance for new requests.

Privacy information explains data processing. Accepting these Terms is not blanket data protection consent. Optional voice input has a separate notice and starts only through your explicit action. These Terms do not limit statutory consumer rights or statutory liability.
